When a personal injury Claimant brings a successful claim for compensation the Compensation Recovery Unit (CRU) works with insurance companies, solicitors and the DWP to recover any related benefits already paid to the Claimant. This is based on the principle that a person should not be compensated twice in respect of the same accident, injury or disease.
If you are the compensator in the case, (the person or organisation likely to be paying the compensation) you must tell the CRU before any payment is made. The CRU will send you a certificate of recoverable benefit and a copy of the certificate to the Claimant. The certificate shows how much benefit, if any, the compensator has to pay back to the DWP. This is paid before the compensation award is settled with the Claimant.
The CRU Certificates that are produced by this process can make up around 10% of the daily documents received in an insurance company’s mailroom. Out of the thousands of these documents received each week, up to 90% could have no value attached. Despite this your claim handlers still need to record the value and store this document.
